A new petition calls for legal changes to make courts recognise pets as family members instead of property. It currently has almost 4,500 signatures but needs at least 10,000 to ensure the government responds. The deadline for signatures is 27th September.

The petition asks for changes to:
make pet welfare the top consideration when resolving disputes over their ownership
recognise a pet's value to its owner, not just its price
resolve disputes quickly.
What happens to pets now
Current rules concerning pets affect many different issues, including claims to keep them during family disputes. This can happen when someone dies, leaving a pet behind, if they haven’t made any provision in their Will.
Courts don’t consider animal welfare or a pet’s bonds with family members when making decisions. In fact, they treat pets as replaceable items like furniture or clothes.
Pet friends
Well over half of UK households have pets. A survey by pet food manufacturer, Purina, found that almost three quarters of pet owners regard their pets as friends. The Dogs Trust 2024 National Dog Survey found 99% of dog owners see their dogs as part of the family.
Legislation passed in 2022 recognised that animals have thoughts and feelings to make sure government policies take account of their welfare. Pet abduction is now also a criminal offence.
How to provide for your pet in your Will
Pet custody cases reportedly increased by almost 40% between March 2024 and March 2025. While this often happens during family separations and divorces, it’s also a concern when someone dies.
To make sure your pets have good homes it’s a good idea to include them in your Will. By confirming who will look after them you will also avoid any disputes. You can include a named person to take care of them, as well as a secondary option in case they can’t do so.
Of course, looking after animals includes the costs of food and care. You might want to make some financial provision too. However, you can’t leave anything to your pet because current rules treat them as possessions. However, you can include items to stay with your pets, such as their beds or cages, favourite toys or collars.
It’s important to check that the people you choose are happy to take on responsibility for your pets.
